These Terms of Service ("Terms") govern your access to and use of the Homie application and related services provided by GIGA MOW, LLC ("we", "us"). By using Homie, you agree to these Terms.

Homie uses AI to generate interior design suggestions. Results are suggestions only and should be verified for accuracy and feasibility. You are responsible for your use of the app and any decisions made based on generated content.

We may update these Terms from time to time. Continued use constitutes acceptance of the updated Terms.

Homie - AI Interior Design

1. Agreement to Terms

By downloading, installing, or using the Homie - AI Interior Design mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you do not have permission to access or use the App.

These Terms constitute a legally binding agreement between you and GIGA MOW, LLC ("Company," "we," "us," or "our") concerning your use of the App.

2. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18 years old, you must have your parent or legal guardian's permission to use the App. By using the App, you represent and warrant that:

  • You have the legal capacity to enter into a binding agreement
  • You are not barred from using the App under any applicable laws
  • You will comply with these Terms and all applicable local, state, national, and international laws

3. Account Registration

To access certain features of the App, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Immediately notify us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. App License and Usage

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

License Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, disassemble, or decompile the App
  • Remove any proprietary notices or labels from the App
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or networks
  • Use automated systems or software to extract data from the App
  • Interfere with or disrupt the App's functionality
  • Use the App to transmit viruses or malicious code
  • Violate any third party's rights, including privacy and intellectual property rights

5. User Content

Your Content

The App allows you to upload, submit, and share content including photos of rooms, design preferences, and other materials ("User Content"). You retain ownership of your User Content, but by uploading it to the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and providing the App.

Content Guidelines

You agree that your User Content will not:

  • Violate any third party's rights, including copyright, trademark, privacy, or publicity rights
  • Contain false, misleading, or deceptive information
  • Include personal information of others without their consent
  • Contain offensive, obscene, or inappropriate material
  • Promote illegal activities or violate any laws

Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice and at our sole discretion.

6. AI-Generated Content

The App uses artificial intelligence to generate interior design recommendations ("AI Content"). You acknowledge and agree that:

  • AI Content is provided for inspiration and guidance only
  • We do not guarantee the accuracy, suitability, or feasibility of AI Content
  • You should consult with qualified professionals before making significant design decisions
  • AI Content may not account for structural limitations, building codes, or safety requirements
  • You are solely responsible for any decisions made based on AI Content
  • AI-generated designs are not professional architectural or interior design services

7. Subscription and Payments

Free and Premium Features

The App offers both free and premium features. Premium features require a paid subscription ("Premium Subscription").

Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change subscription fees with 30 days' notice
  • You are responsible for any taxes applicable to your subscription

Auto-Renewal

Premium Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your device's app store settings.

Free Trial

We may offer free trials for Premium Subscriptions. At the end of the free trial, you will be automatically charged unless you cancel before the trial period ends.

8. Intellectual Property

Our Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, design, selection, and arrangement) are owned by GIGA MOW, LLC, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Feedback

Any feedback, suggestions, or ideas you provide about the App become our property and may be used without compensation or attribution to you.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

10. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content or services.

11. Disclaimers

As-Is Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR SECURE.

No Professional Advice

The App does not provide professional interior design, architectural, or construction advice. Always consult with qualified professionals before undertaking any home improvement projects.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GIGA MOW, LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100) IF YOU HAVE NOT MADE ANY PAYMENTS TO US.

13. Indemnification

You agree to defend, indemnify, and hold harmless GIGA MOW, LLC and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the App
  • Your User Content
  • Your violation of any third party's rights
  • Any harm caused by your use of AI-generated content

14. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • You must delete all copies of the App from your devices
  • All provisions of these Terms that should survive termination will remain in effect

15. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Arbitration

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in California, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver

YOU AGREE THAT ANY DISPUTES SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.

17. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GIGA MOW, LLC regarding the use of the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights under these Terms without your consent.

19. Apple App Store Additional Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and GIGA MOW, LLC only, not with Apple
  • Apple has no obligation to provide maintenance or support services for the App
  • Apple is not responsible for any product warranties or claims
  • Apple is not responsible for addressing any third-party claims relating to the App
  • Apple and its subsidiaries are third-party beneficiaries of these Terms

20. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
